Creator-Fan Agreement

Key understanding: licensing model

SneakPeach operates on a licensing model, not direct Creator-Fan payments:

1. Fans pay SneakPeach for content access licenses
2. Creators grant SneakPeach distribution rights to their content
3. SneakPeach grants limited viewing licenses to paying Fans
4. Creator earnings are determined by our Creator Earnings Policy

Payment processing

• All payments are made to SneakPeach - not directly to Creators
• SneakPeach retains a 20% platform fee from all transactions
• Creator earnings are paid according to our payout schedule
• Fans receive content access licenses upon successful payment
• No direct financial relationship exists between Fans and Creators

License scope

Fans may:

• • View purchased content for personal use
• • Access content via approved browsers and apps
• • Download content where explicitly permitted
• • Engage with Creators through platform messaging

Fan restrictions

Fans may nOT:

• • Copy, share, or redistribute content
• • Screen record or capture content
• • Use content for commercial purposes
• • Bypass platform security or payment systems
• • Request refunds for consumed digital content
• • Harass or abuse Creators
• • Share personal contact information

Fan indemnification

Fans agree to indemnify SneakPeach for any losses resulting from breach of license terms, including but not limited to unauthorized content sharing, payment disputes, chargebacks, or violations of this Agreement.

Content distribution license

By uploading content, Creators grant SneakPeach a worldwide, sub-licensable, transferable license to:

• Host, display, and distribute content to paying Fans
• Grant limited viewing licenses to Fans who purchase access
• Use content for platform marketing and promotion
• Process content through moderation and security systems
• Store and backup content for platform operation

Creator warranties & compliance

Creators warrant that:

• • They own or control all necessary rights to uploaded content
• • All depicted individuals are 18+ with documented consent
• • Content complies with all applicable laws and regulations
• • They maintain required age verification records per 18 USC § 2257
• • Content does not infringe third-party rights
• • No content depicts violence, non-consensual acts, or illegal activities
• • They maintain model identification records for minimum 7 years
• • All content creation involved consenting adults with valid ID verification
• • They comply with tax reporting obligations in their jurisdiction

2257 Record-Keeping Requirements

US Law Compliance (18 USC § 2257):

• • Creators must maintain records proving age verification of all depicted individuals
• • Records must include government-issued photo identification
• • Records must be retained for 7 years after content creation
• • Records must be made available for inspection by authorized officials
• • Failure to comply may result in criminal penalties and account termination
• • SneakPeach may request verification documentation at any time

Prohibited content

Strictly Prohibited Content:

• • Any content involving individuals under 18 years of age
• • Non-consensual content or revenge pornography
• • Violence, abuse, or content depicting harm
• • Content promoting illegal activities or substances
• • Copyrighted material without proper authorization
• • Content that violates platform community guidelines
• • Deepfake or AI-generated explicit content without disclosure
• • Content that promotes discrimination or hate speech

Creator earnings

• Creators receive 80% of Fan Payments (after 20% platform fee)
• Earnings are governed by our Creator Earnings & Payout Policy
• No direct payment relationship exists with individual Fans
• SneakPeach reserves the right to withhold payments for policy violations
• All tax obligations and reporting are the Creator's responsibility
• Minimum payout threshold of €50 must be reached before payment processing
• Chargebacks and payment disputes may result in earning deductions

Tax compliance & reporting

Tax Obligations:

• • US Creators: Must provide valid SSN or EIN for 1099 reporting
• • EU Creators: Must provide VAT number if applicable
• • International Creators: Subject to applicable tax withholding
• • Creators responsible for reporting all income to tax authorities
• • SneakPeach may withhold taxes as required by law
• • Annual tax documents provided by January 31st
• • Currency conversion rates determined at payment processing time
• • Creators must update tax information when requested

License expiration

Fan content access licenses expire immediately upon:

• Payment reversal or chargeback
• Subscription period end (unless renewed)
• Account termination or suspension
• Creator content deletion
• Fan account closure
• Violation of license terms

No guarantees

SneakPeach makes no guarantees regarding:

• • Continuous availability of content
• • Frequency or quality of Creator uploads
• • Creator response to messages
• • Content compatibility with Fan preferences
• • Creator account permanence

Subscription terms

• Subscriptions automatically renew unless cancelled
• Standard subscription period is 30 days from payment date
• Subscription prices are set by Creators and subject to change
• Price changes require Fan confirmation for future billing
• Cancellation takes effect at the end of current subscription period
• No refunds for partial subscription periods

Cancellation rights

By purchasing subscriptions or pay-per-view content, Fans consent to immediate digital content delivery and waive statutory cancellation rights under consumer protection laws. This does not affect rights to request refunds where required by law.

Fan-Platform disputes

• All disputes are between Fans and SneakPeach (not Creators)
• Must first attempt resolution through our support system
• Disputes are subject to our Complaints Policy
• Governed by Dutch law with Amsterdam jurisdiction
• Mandatory mediation before litigation

Creator-Fan communication

While SneakPeach may facilitate communication between Creators and Fans, we are not obligated to mediate disputes between them. All official transactions and licensing remain exclusively between the respective parties and SneakPeach.

Termination triggers

Immediate Account Termination:

• • Uploading prohibited content (minors, non-consensual, violent)
• • Violation of 2257 record-keeping requirements
• • Payment fraud or chargeback abuse
• • Harassment, doxxing, or threats against users
• • Multiple community guideline violations
• • Legal non-compliance or law enforcement request
• • Circumventing platform security or payment systems
• • False identity or impersonation

Data retention after termination

Data Handling Post-Termination:

• • Content immediately removed from public access
• • Backup data retained for 90 days for legal compliance
• • Financial records retained for 7 years per tax law
• • Age verification records retained per 2257 requirements
• • Account recovery possible within 30 days for eligible terminations
• • GDPR deletion requests honored after legal retention periods
• • Law enforcement data may be retained indefinitely

Final payout procedures

Termination Payouts:

• • Earned balance paid within 30 days for compliant terminations
• • Payment withheld for policy violations until dispute resolution
• • Chargebacks and refunds deducted from final payout
• • Minimum payout threshold waived for final payments
• • Payment method must remain valid for 60 days post-termination

Limited liability

SneakPeach's total liability is limited to:

• €100 maximum for consumer users
• €1,000 maximum for business users
• Total amount paid in the 12 months preceding any claim

Excluded damages include loss of profits, data, or business opportunities.

Platform disclaimers

SneakPeach Disclaims Liability For:

• • User-generated content accuracy, legality, or appropriateness
• • Creator-Fan interactions and communications
• • Third-party payment processor failures or delays
• • Technical service interruptions or data loss
• • Content availability or creator account continuity
• • Currency exchange rate fluctuations
• • Tax implications or compliance issues
• • Creator compliance with age verification laws
• • Disputes between users outside platform scope

User indemnification

Both Creators and Fans agree to indemnify SneakPeach against all claims, damages, and legal costs arising from:

• Use of the platform in violation of these terms
• Content uploads, sharing, or distribution
• Payment disputes, chargebacks, or fraud claims
• Violations of applicable laws or regulations
• Breach of age verification or consent requirements
• Third-party claims related to user content
• Tax evasion or misreporting of income
